The Israeli occupation forces (IOF) arrested and transferred Fadi Ayiada Al Azazma, 19, who lives in Hebron City in the West Bank to the Gaza Strip.
Al Azazma was arrested while he was at his work in the West Bank.
In the early hours of Tuesday 27 April 2010, the IOF transferred Al Azazma to the Gaza Strip at Erez crossing.
Al Mezan Centre for Human Rights condemns the Israeli continuous expulsion and the forcible transfer of Palestinians under the Military Order 1650 which constitutes a grave violation of the international law.
Al Mezan calls on the international community to promptly intervene to stop these violations and to ensure the return of the deportees to their families and homes in the West Bank.
In the second forcible transfer of Palestinians living in the West Bank whose registered address is in the Gaza Strip, the IOF expelled Fadi Ayiada Al Azazm, 19, who lives in Hebron City in the West Bank to the Gaza Strip.
Al Azazma was arrested while he was at his work at the Hebron market in the West Bank.
The IOF detained Al Azazma for several hours at Ofer Prison.
Al Azazma and his family live in Hebron city for 15 years.
Al Azazma has refused to enter into the Gaza Strip and in protest at his expulsion has joined Ahmed Sabbah, who was deported to the Gaza Strip on 21 April 2010, at Erez Crossingin the deportees' tent.
Al Azazma was expelled to the Gaza Strip under the military order 1650 regarding the “Prevention of Infiltrators' in the West Bank.
According to this order, the Israeli military commander can expel any person who is present in the West Bank without a permit from the IOF.
Al Mezan has warned of the consequences of this order which authorizes the IOF to expel large numbers of Palestinians living in the West Bank to the Gaza Strip, particularly those whose registered addresses are in the Gaza Strip.
Al Mezan asserts that the forcible transfer of Palestinians is only part of Israel’s violations in the OPT.
Since 2000, the IOF refused to change thousands of addresses of Palestinians who have moved from the Gaza Strip and now live in the West Bank.
This means that that a large number Palestinians' could be expelled under the military order 1650.
The IOF did not give Al Azazma the opportunity to appeal before any judicial or military committee or body.
This actually violates the new military orders, which themselves violate international humanitarian law (IHL).
Al Mezan asserts that the expulsion and the forcible transfer of Palestinians in the West Bank under the military order 1650 constitute a grave violation of international law.
Article 49 of the Fourth Geneva Convention Relative to the Protection of Civilians in Times of War, of 1949, prohibits an occupying power from forcibly transferring protected persons from occupied territories.
Al Mezan points out that the expulsion and the forcible transfer are acts of war crimes and crimes against humanity under Rome Statue of the International Criminal Law.
Al Mezan's asserts that the forcible transfer is limited to very strict conditions: only if imperative military reasons or if the security of the population so demand, both of which are not applicable to cases at hand.
Al Mezan Center for Human Rights strongly condemns the latest Israeli violation and expresses its deep concern regarding the risk that a large number of Palestinians could be expelled under the military order 1650.
Al Mezan calls on the international community particularly the high contracting parties to the Fourth Geneva Convention to immediately intervene to stop the new Israeli and to provide international protection to the Palestinians in the OPT.
